Terms & Conditions of Sale
1. Definitions
“Company” means TurboCentras Ireland Ltd.
“Customer” means the purchaser of goods.
“Consumer” means a natural person acting outside the course of business.
“Business Customer” means any purchaser acting in the course of trade, business or profession.
2. Acceptance of Terms
All sales are subject to these Terms & Conditions.
By purchasing goods from the Company, the Customer confirms acceptance of these Terms.
3. Installation Requirements (Applies to All Customers)
Warranty is strictly conditional upon correct installation procedures being followed.
The Customer must ensure:
Oil feed pipe is replaced.
Oil system is flushed.
New oil and oil filter are fitted.
Oil pressure is verified to manufacturer specification.
Air intake and intercooler are inspected and cleaned.
DPF, EGR, and crankcase ventilation systems are inspected.
The root cause of any previous turbo failure is identified and rectified.
Failure to comply voids warranty.
4. Return & Inspection Requirement
No warranty claim will be accepted unless:
The complete turbocharger unit is returned.
The unit is inspected by the Company.
An installation checklist is submitted if requested.
Third-party or independent reports shall not be binding on the Company.
5. Exclusions
Warranty does not cover damage caused by:
Oil contamination
Oil starvation
Carbon build-up
Blocked DPF or exhaust systems
Particle ingress
Overheating
Improper installation
Tampering or dismantling
Labour costs are not covered.
6. Limitation of Liability
To the maximum extent permitted by law:
The Company’s liability shall be strictly limited to repair, replacement, or refund of the turbocharger unit supplied.
The Company shall not be liable for:
Labour costs
Vehicle recovery
Loss of earnings
Diagnostic charges
Consequential or indirect loss
Additional mechanical damage
7. Business Customers
For Business Customers:
All implied terms, conditions, and warranties are excluded to the fullest extent permitted by law.
Business Customers acknowledge that turbochargers are precision components requiring professional installation.
8. Consumers
Nothing in these Terms limits statutory rights of Consumers under Irish law.
Where goods are found to be inherently defective, remedies shall be limited to repair, replacement, or refund at the Company’s discretion.
9. Governing Law
These Terms are governed by the laws of Ireland.
Consumer Remedies
Where a Consumer establishes that goods were inherently defective at the time of supply, the Company shall be entitled, at its discretion, to:
Repair the turbocharger; or
Replace the turbocharger; or
Provide a refund of the purchase price.
Remedies shall be limited to the turbocharger unit supplied and shall not extend to any associated labour or consequential costs.
Assessment of Claims
The Customer acknowledges that turbocharger failure may result from factors unrelated to manufacturing defects. The Company reserves the right to determine, following inspection, whether failure arises from defect, installation error, contamination, or external mechanical causes.
